Establishing Justice in Middle America: A History of the United States Court of Appeals for the Eighth Circuit
Price: $39.95
Author: Jeffrey Brandon Morris
Manufacturer: Univ Of Minnesota Press
In Establishing Justice in Middle America, Jeffrey Brandon Morris covers its history, from its founding in 1866 through the present day. Morris also provides a panoramic view, discussing how the court has changed over time, the judges who have served on the court, and all of the court’s major cases. This work is one of the first histories of a court in the mostly regional tier of federal courts that are, judicially speaking, nearest to the Supreme Court.
Establishing Justice in Middle America reveals how, in many ways, the history of a regional court is a history of the nation itself.
Jeffrey Brandon Morris is professor of law at Touro Law Center in Long Island, New York. He is the author or editor of sixteen books, including histories of four federal courts, and is editor of the Encyclopedia of American History.
Published for the Historical Society of the United States Courts in the Eighth Circuit.

From the supplier: The Massachusetts District US Bankruptcy Court ruled in A. J. Lane & Co, In re that a bankruptcy trustee could not abandon debt-encumbered property to the debtor to reduce the bankruptcy estate's tax liability because foreclosure was imminent. The Court found that abandonment violated the fresh start principles of bankruptcy by transferring tax liabilities to the debtor. This decision conflicts with the Eighth Circuit and US Bankruptcy Court of Northern Iowa rulings, so tax professionals should not assume the issue is concluded.

From the supplier: The Court of Appeals for the Eighth Circuit affirmed the Tax Court decision in Honeywell, Inc. that spare parts held for use in providing a maintenance service were assets and not merchandise and were therefore depreciable. The IRS had ruled that rotable parts that Honeywell stocked to use the maintenance of computers that it sold and leased were inventory. The Court looked to the flat fees charged by Honeywell that bore no relation to the parts used and the fixed asset method of accounting used to determine that Honeywell was not in the business of selling these parts.
